Terms, limitation of liability, and operator responsibility
By using this atlas you agree that listed operators—not Utah Hardscaping & Supply—are solely responsible for their products, work, availability, and distribution.
Independent operators
This website and iPhone Home Screen app is a directory and mapping tool published by Utah Hardscaping LLC, doing business as Utah Hardscaping & Supply (“UH&S,” “we,” “us”). Except for UH&S’s own Kearns yard (5612 Hwy 111, Salt Lake County) and posted UHSA price list, every quarry, pit, landscape yard, third-party seller, excavator, and contractor shown here is an independent business. Listing, mapping, certification, or membership does not create a partnership, joint venture, employment, agency, or fiduciary relationship. UH&S does not control those operators and does not assume their contracts, crews, trucks, inventory, or jobs.
Provider and contractor responsibility
Each listed provider, contractor, and hauler is solely responsible for: (a) the truth of its name, contact data, and claims; (b) product quality, grade, moisture, contamination, and specification (including any “state spec” or road-base claim); (c) quantity, load size, work size, and yield; (d) stock and availability on the day of pickup or delivery; (e) weighing, ticketing, and measurement; (f) loading, tarping, securement, and FOB transfer of risk; (g) all distribution, trucking, dispatch, routing, and delivery windows, whether arranged by the operator, a third-party hauler, or through introductions made on this site; (h) missed, short, late, dumped, or refused loads; (i) damage to property, utilities, pavement, landscaping, or persons arising from its work; and (j) licenses, CDL, USDOT/MC if claimed, insurance, OSHA/MSHA, environmental, and tax compliance. UH&S is not the shipper, carrier, broker of record, or general contractor for third-party work unless a separate written contract with UH&S says so.
No warranty of information
Map pins, phone numbers, hours, commodities, employee counts, total tons, FOB figures, delivery fees, and “carries” notes are compiled from public records (including MSHA, USGS, USDA NRCS, NWS, Open-Meteo, the U.S. Census, and OpenStreetMap), operator statements, modeled estimates, and UH&S’s own posted UHSA Kearns list. They may be incomplete, outdated, geocoded only to a town or highway, or wrong. Figures labeled as modeled or estimated are not surveyed production. Sparkles takeoffs and any “rough engineered estimate” are planning aids from posted UHSA FOB, geometry, and a photo — not a licensed estimator, professional engineer, geotech, flood certificate, bid, or dispatch promise. UH&S does not warrant accuracy, completeness, or fitness for a particular purpose. You must confirm every order, spec, tonnage, price, and schedule with the selling operator before relying on it.
Pricing, FOB, and delivery
Unless clearly marked as UH&S’s posted UHSA Kearns list, prices are third-party quotes, historical averages, or estimates. FOB means pickup at the named site; title and risk pass per that operator’s terms. Trucking, fuel, wait time, dumping, and extras are not included unless that operator says so in writing. UHSA delivery fees apply only when UH&S is the seller (one county fee per 13 tons or any portion). UH&S is not liable for another company’s price change, surcharge, tax, short load, product mix-up, contamination, freeze-thaw, or a missed delivery.
Certification and inspections
“Certified provider,” “certified contractor,” “certified landscaper,” inspection, membership, or a public listing means only that the operator applied and, if activated, paid UH&S consulting for a quality review of the listing. It is not a bond, insurance policy, guarantee of stock, DOT acceptance, DOPL licensure, or warranty of workmanship. Certified-provider and certified-landscaper applications require a current Utah business license; any additional certifications listed on the application (MSHA, UDOT, APWA, irrigation, ISA, scale tickets, insurance, or similar) are submitted for UH&S review only and are not independently verified beyond what the applicant provides. Certified-contractor applications require a current Utah contractor license. UH&S may accept, delay, or remove a listing at its discretion. Consumer use of the atlas is free. Fees ($299 year one / $99 thereafter for certified providers; $349 year one / $149 thereafter for certified contractors and haulers; $249 year one / $99 thereafter for certified landscapers; $29/month Compare desk) are for directory access, the bid desk, Open bids routing, and review — not for the underlying materials or excavation. Certified landscaper does not include Yard stock or Clock. Compare desk is not a certified listing.
Open bids and U3P
The Open bids desk is a convenience filter for certified contractors. It routes public Utah opportunities that look like excavation, road, drainage, landscape, materials, or hauling work. Official advertisements, addenda, plans, and electronic submittals exist only on the Utah Public Procurement Place (U3P) at utah.bonfirehub.com, operated by the State of Utah / Bonfire (Euna). Additional points of interest (UDOT Contractor Zone, Utah Public Notice Website, campus BidNet, SAM.gov, and similar) are outbound links only — UH&S does not ingest, award, or take those bids. UH&S is not the procurement officer, does not evaluate or receive bids, and does not warrant that a filtered list is complete, current, or the right fit for your license. Watching a bid in UHSA is not a response. You must register and submit on U3P.
Acceptable use
You agree not to scrape, republish, or misrepresent listings; not to treat blurred or gated data as a license to harass operators; and not to hold UH&S responsible for accounts, passwords, or third-party sign-in (Google, X, or otherwise). Blurred names, hidden phones, and public FOB for certified yards are directory features, not legal conclusions about any company.
Release and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY UTAH LAW, UH&S, ITS OWNERS, MEMBERS, EMPLOYEES, AFFILIATES (INCLUDING STRANG LLC AS A SEPARATE EXCAVATION COMPANY), AND CONSULTANTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DELAY, COVER, OR PROJECT DAMAGES, ARISING FROM THIS ATLAS, A LISTING, A PRICE, A PIN, A REFERRAL, MISINFORMATION, A MISSED PRODUCT, A MISSED OR WRONG DELIVERY, SHORTAGES, SPEC FAILURE, OR ANY OPERATOR’S WORK. UH&S’S TOTAL LIABILITY FOR A CLAIM RELATED TO THIS ATLAS IS LIMITED TO THE MEMBERSHIP FEES YOU PAID UH&S IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NONE.
Indemnity
If you are a listed provider, contractor, hauler, landscaper, or a user who orders from one, you will defend and indemnify UH&S against claims, damages, and reasonable attorneys’ fees arising from your products, hauling, excavation, landscape work, representations, or your use of this site, except to the extent caused by UH&S’s own gross negligence or willful misconduct in filling an UH&S-sold order.
UH&S sales and Strang LLC
When you buy from Utah Hardscaping & Supply, UH&S’s posted UHSA Kearns list, delivery zones, and any written quote govern that sale only. Checkout in this app is an order request — not a charge, not a bid, not a guaranteed load. Philip Ely (Sales) confirms stock, tax, and timing by phone. Sister-company excavation through Strang LLC is a separate contract with Strang LLC. Nothing here waives claims you may have on a load UH&S itself sold and hauled under its own ticket.
UHSA jobs
The Bids tab lets members post public or private job opportunities (excavation, haul, material, landscape, looking for work). A homeowner or project owner with Compare desk may post a residential public bid to receive estimates. Posts require a contact name, working phone, site street, and may include photos of the yard or a plan page. A poster may attach a takeoff schedule with optional budget unit prices (including a Sparkles planning takeoff). Signed-in members on that job see the schedule and any budget figures — that is not a required markup and not a PE stamp. Certified contractors, haulers, providers, and landscapers may submit a dollar amount or their own workbook with a phone. Bid totals and bid unit prices are visible only to the poster (and the bidder sees their own). Markup percent is stored on the bid and shown only to that bidder — not the poster, not other crews, not UH&S as a public listing. The poster may mark a winner in the app. That mark is an introduction, not a contract, and not a Utah Public Procurement Place award. Official public procurement stays on U3P (utah.bonfirehub.com). UH&S does not take a cut, does not evaluate U3P bids, and does not guarantee a reply. When you tap Call, open a bid form, or submit a bid on a UHSA job, UH&S records that as a job lead for the owner desk.
Sparkles
AskSparkles is an automated materials desk. It uses UHSA posted FOB, Utah planning averages for unlisted items, and live public-record lookups (USDA NRCS soil, USGS elevation and stream gages, NWS and Open-Meteo weather, OpenStreetMap, U.S. Census). It may also search the open web for Utah planning typicals (UDOT, AirNow, drought) — never to invent UHSA posted FOB. A “rough engineered estimate” here means a planning takeoff: posted coverage × size (or a site photo) plus county delivery. It is not a licensed estimator, professional engineer, geotech, or attorney, not a bid, and not contractor markup. A site photo may be used to size the job and to paint a posted product into beds or turf as a planning view only — not a finished job. It can be wrong. You may drop that takeoff onto a UHSA job as a bid schedule (quantities and UHSA unit prices, no markup). Irrigation is not sold on this desk.
iPhone app and payments
UHSA is offered as a web app you may add to the iPhone Home Screen. Membership fees ($299 / $99 certified provider; $349 / $149 certified contractor or hauler; $249 / $99 certified landscaper; $29/month Compare desk for additional-yard names and estimated FOB) are invoiced by UH&S for directory review — they are not Apple In-App Purchases and are not charged through the App Store. You may pay that invoice on Venmo Business @RNG801 (venmo.com/u/RNG801). That payment leaves this app. UH&S activates the listing or Compare desk after the payment is confirmed. Material tickets are requests to buy physical goods (rock, soil, mulch, road base). No card is collected in the app. Guest checkout is allowed with a name and working phone.
Security
UH&S uses sign-in, same-site request checks, role permissions, and size limits on photos and desk traffic. No website is 100% secure. We do not warrant that UHSA is free of bugs, outages, unauthorized access, or data loss. You are responsible for your own passwords, devices, and who you text a yard join code to. Do not put card numbers, Social Security numbers, or other secrets in listing fields, Sparkles, or bid notes. Report a suspected hole to 385-888-7625. This notice is not a security certification, audit, or guarantee.
Governing law
These terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Exclusive venue is the state or federal courts sitting in Salt Lake County, Utah. If a provision is unenforceable, the rest remains. UH&S may update this notice; continued use is acceptance. This is a limitation-of-liability notice, not legal advice to you.
